
HP wants you to donate your desktop. In fact, they think it’s such a good idea that they’ve decided to sponsor a competition to help us build our user base.
Anyone who downloaded and installed the Donate Your Desktop application before the 5th August 2012, was in to win an HP Envy 14 Beats™ Audio edition laptop and a pair of Beats™ by Dr. Dre Solo headphones.

It will never cost you a cent to donate your desktop to one of our partner charities. We make the donations on your behalf from the fees we charge advertisers for our services.
All you have to do is select a charity and download our simple application (for Windows and Mac). Each day, we will renew your wallpaper with a fresh design sponsored by an advertiser. In return, we donate 75% of our advertising revenue to your chosen charity.

These terms and conditions (“Terms”) govern the competition (“Competition”) being administered by Donate Your Desktop New Zealand Limited (“DYD”) to go into a draw to win an HP Envy 14 Beats™ Audio edition laptop and Beats™ by Dr. Dre Solo Headphones (the “Prize”). The registration and verification of an account with DYD (in accordance with clause 5 below) is deemed to be acceptance of these Terms. Persons that do not comply with these Terms may be disqualified from, or refused entry into, the Competition without further notice.
The Competition commences on 9 July 2012 at 12.01am and ends on 5 August 2012 at 11.59pm (the “Competition Period”).
The Competition is only open to eligible entrants (“Entrants”), being persons who are:
(a)
New Zealand residents; and
(b)
not a director, shareholder or employee of DYD or its holding company, Donate Your Desktop Limited, or an immediate family member of such persons.
The Prize is not transferable and cannot be exchanged for cash or other alternatives. The image featured at the top of this page is not an accurate representation of the prize.
In order to enter the Competition, Entrants must, before the end of the Competition Period:
(a)
have registered an account with DYD through its branded desktop downloading application (the “Application”). The Application may only be downloaded from internet protocol addresses that DYD's server registers as being located in New Zealand; and
(b)
have verified their account using the verification link to be provided by DYD in a "welcome email" to the Entrant.
Entrants whose accounts with DYD are registered through Facebook are deemed to be automatically verified for the purposes of these Terms. For the avoidance of doubt, Entrants who have registered and verified their account with DYD before the commencement of the Competition Period will be given automatic entry into the Competition.
Entrants will be able to share the Competition with others by:
(a)
logging into their account with DYD on DYD's website at www.donateyourdesktop.co.nz (the “Website”);
(b)
accessing the official page on the Website relating to the Competition (the “Competition Page”); and
(c)
clicking on the relevant buttons on the Competition Page that enable Entrants to share the Competition via Facebook or Twitter; or
(d)
providing to DYD the email addresses of people that will be happy to receive an email from DYD regarding the Competition (a "Competition Email”). It is the Entrant's responsibility to ensure that such persons consent to the receipt of a Competition Email.
The Facebook post or tweet that will be generated, or Competition Email that will be sent, will contain a URL link to the Competition Page that will be linked to the Entrant's account with DYD (the “Competition URL”). Entrants will be given one additional entry into the Competition for each person that, in accordance with these Terms and before the end of the Competition Period:
(e)
accesses the Competition Page using the Competition URL;
(f)
downloads the Application; and
(g)
registers and verifies an account with DYD.
DYD will not be held responsible or liable for entries that are (for whatever reason) not properly registered in its database of Entrants (whether DYD was responsible for this or otherwise).
On 13 August 2012, the winning Entrant of the Competition (the “Winner”) shall be randomly selected by a representative of DYD at the company's registered office from its database of Entrants. The Winner will then:
(a)
be announced on DYD's Website (the “Announcement”); and
(b)
be notified by email to the Winner's registered email address with DYD (the “Email Notification”).
If the Winner does not respond to the Email Notification within 7 days of the Announcement indicating that they wish to claim the Prize (“Claim”), that Winner shall lose their entitlement to Claim and the procedure set out in this clause 8 shall be repeated by DYD until a Winner that is selected Claims.
All Entrants agree that, if they are selected to be the Winner, they will allow DYD to use their name (without any compensation) to make the Announcement and for publicity and promotional purposes on the Website and in any other media that DYD considers appropriate.
DYD reserves the right to amend or update these Terms, to change or substitute the Prize, and/or to change or terminate the Competition at any time with or without notice. All decisions made by DYD in relation to the Competition will be final and binding on all Entrants, and DYD shall not be obliged to enter into any correspondence in relation to its decisions.
Except for liability that cannot be excluded by law, neither DYD, Hewlett Packard New Zealand (“HP”), Facebook or Twitter shall be liable to any person or entity for any loss or damage suffered in relation to this Competition or the Prize (including, without limitation, in negligence and for indirect or consequential losses). Furthermore, all Entrants acknowledge and agree that:
(a)
the Competition is neither sponsored, endorsed or administered by, or associated with, HP, Facebook or Twitter;
(b)
by entering the Competition, they are providing information to DYD and not to HP, Facebook or Twitter;
(c)
DYD makes no representations as to the quality or fitness for purpose of the Prize; and
(d)
DYD is not responsible for any technical malfunction, delay or loss of data that occurs in connection with the Competition (however caused).
Each Entrant indemnifies, and will keep indemnified, DYD, HP, Facebook and Twitter against all forms of liability, actions, proceedings, demands, costs, charges and expenses that these parties may suffer, incur or be subject to in relation to this Competition that are caused by the Entrant.
These Terms do not invalidate or supersede DYD's general terms of use, which are located on the Website at www.donateyourdesktop.co.nz/terms and which shall apply in full to each Entrant's use of the use the Website, Application and the computer desktop advertising and donation services offered by DYD.
DYD collects personal information about Entrants as part of administering this Competition. For further information about what personal information DYD collects, and how it treats that personal information, please see DYD's privacy policy at www.donateyourdesktop.co.nz/privacy.
These Terms shall be governed by New Zealand law, and all Entrants submit to the exclusive jurisdiction of the New Zealand courts for any matter or dispute arising in relation to these Terms.
